Terms & Conditions

These are the Terms & Conditions of Ms Kathryn Jean Kaars, trading as Ms Kathryn Jean Kaars (ABN 25 328 522 966) (“Katie Kaars”, “we”, “us”), relating to www.katiekaars.com and the photography and related services we offer.

Please read these conditions carefully before booking or purchasing a service.

These Terms & Conditions provide general information about photography sessions, Pix Fix personalised digital photo reviews and other services offered through our website or linked booking pages.

Photography clients receive a separate photography contract to review and sign through Dubsado. The signed photography contract sets out the agreed session details, payment arrangements, cancellations, image licensing and other session-specific conditions.

Pix Fix customers should review the conditions presented for their purchase. Our Privacy Policy and other relevant agreements should also be read. Third-party booking and payment platforms may have their own terms and privacy practices.

1. Bookings, services and pricing

We take care to keep our service descriptions, availability and pricing accurate and up to date.

Photography package prices expressly described as GST-inclusive include GST. Other fees and additional services may be quoted separately, with applicable GST identified in the booking details or invoice.

Photography sessions are confirmed in accordance with the signed photography contract and the payment requirements in Section 2.

If we identify an error affecting a booking, service description or price, we will contact you as soon as practicable to explain the issue and discuss suitable options, including an adjustment, an alternative arrangement or any refund required by law.

Any additions to or changes in the agreed photography services may involve further fees, which will be communicated in accordance with the photography contract.

These Terms & Conditions do not remove rights or obligations arising from goods or gift vouchers purchased under earlier arrangements.

2. Payment, cancellations and refunds

2.1 Photography bookings and payment

For standard photography sessions, the signed contract and a 20% booking deposit secure the session date. The remaining 80% will be invoiced the day before the shoot and is payable that day.

The deposit is credited towards the agreed photography fees; it is not an additional charge.

GST applies in accordance with the agreed booking details. Where a photography package price is expressly advertised as GST-inclusive, that price includes GST. The booking details and invoice will identify the applicable charges, GST and total amount payable.

Please review and confirm your shoot details at least seven days before your session. If your booking is confirmed with fewer than seven days remaining, please confirm the details as soon as possible after booking. Any necessary variation to the signed photography contract must be agreed separately.

Agreed additional services, expenses and variations are handled according to the photography contract.

Overdue payments, any interest or recovery costs may be dealt with under the signed photography contract, subject to applicable law.

Styled Portrait Sessions — separate booking payment arrangement

Styled Portrait Sessions may be paid in full or under an event-specific payment plan. The booking details specify the total GST-inclusive fee, amount due at booking and any instalment amounts and due dates. The session is secured when Katie receives the signed contract and the payment due at booking. For cancellations and no-shows, 20% of the total session fee is treated as the booking deposit, forming part of (not adding to) the total fee; payments towards the remaining 80% are refunded, subject to Australian Consumer Law. The standard day-before balance payment schedule does not apply to the event-specific plan.

2.2 Photography cancellations and refunds

We understand that plans can change.

Clients may cancel photography services at any time by notifying Katie Kaars in writing.

If a client cancels or does not attend a session, the 20% booking deposit is non-refundable, subject to Australian Consumer Law. Any payment already made towards the remaining 80% will be refunded. No additional cancellation or no-show fee applies.

If Katie Kaars needs to cancel the photography services and a mutually agreeable alternative date cannot be arranged, the deposit and any photography fees already paid will be refunded.

To request a change to your photography session date, please contact Katie in writing as soon as possible. Rescheduling is considered case by case, at Katie's discretion, acting reasonably and subject to availability. The original booking remains in place until any replacement date and treatment of payments are confirmed in writing.

2.3 Pix Fix bookings and refunds

Pix Fix is a $99 personalised digital photo review. It is an asynchronous service, not a live photography session or coaching call.

Customers submit one to three photographs and Katie provides personalised video feedback within three business days after receiving the photographs.

Pix Fix does not require a separate signed photography contract.

For future Pix Fix purchases, voluntary change-of-mind refunds are not offered, even if work on the personalised review has not begun. Australian Consumer Law rights and any refund promises applicable to existing purchases remain unaffected.

2.4 Standard photography fees and additional charges

The following fees and charges apply to photography services:

  • Standard photography rate: $1,000 plus GST ($1,100 including GST) per hour.

  • Overtime: $200 plus GST ($220 including GST) per hour, prorated for part hours. Overtime begins after the agreed session duration, and any additional work and charges must be agreed before the work is carried out.

  • Travel time: Where separately chargeable, $200 plus GST ($220 including GST) per hour, prorated for part hours.

  • Car travel costs: Calculated using the ATO cents-per-kilometre rate applicable when the quote is prepared. The booking details will identify the starting point, any included travel allowance, return travel arrangements and total GST-inclusive travel charges.

  • Pre-arranged expenses: Reimbursed within seven days of receiving the invoice.

2.5 How services are delivered

Photography sessions and Pix Fix reviews are services and do not involve physical postage.

For photography sessions, finished photographs are delivered through a Dropbox download link within seven business days of the shoot. Business days are Monday to Friday, excluding public holidays in New South Wales.

Where a package is described as including “all edited JPEG images”, this means all of the photographs Katie selects and professionally edits for delivery as finished JPEG files. It does not mean every photograph captured during the session or unedited RAW files.

The Dropbox link remains available for 30 days from the date it is supplied. Clients are responsible for downloading and backing up their photographs within that period; the link may no longer be available afterwards.

Katie retains two backup copies of photography files for one year from the shoot date. This is separate from the client's 30-day Dropbox download window. Storage beyond the one-year period is not guaranteed unless separately agreed in writing.

Additional retouching outside the agreed service inclusions is charged at $33.00 per image, including GST, subject to Katie agreeing to the additional editing.

RAW files are not included in standard photography sessions. If Katie agrees in writing to supply a RAW file, the additional fee is $110.00 per file, including GST. Copyright in the file remains with Katie Kaars.

Pix Fix feedback is delivered separately by email as a personalised digital video review.

3. Events beyond our control

Circumstances beyond our reasonable control, including severe weather, illness, equipment problems, technical failures or disruption to service providers, may affect our ability to deliver an agreed service.

If this happens, we will contact you as soon as practicable to discuss suitable arrangements, which may include rescheduling, alternative delivery or a refund or other remedy required by law.

For photography sessions, the provisions of the signed photography contract also apply, subject to applicable law.

Nothing in this section excludes or limits rights or remedies that cannot lawfully be excluded or limited.

4. Advice and information

We may provide photography, portrait, posing and camera-confidence advice and general information through our website and services. We take reasonable care in preparing this information, although individual photographic results and experiences may vary.

Photography is a creative service and specific images or results may not be guaranteed. The agreed booking details and photography contract describe the services to be provided.

General photography and camera-confidence information is not a substitute for individual medical or psychological advice where that advice is needed.

Nothing in this section limits applicable consumer rights.

5. Australian Consumer Law

Photography sessions and Pix Fix reviews are services to which consumer guarantees under the Australian Consumer Law may apply.

Where applicable, consumer guarantees include that services are provided with due care and skill, are fit for an applicable purpose made known to us, and are supplied within a reasonable time where no timeframe is agreed.

Depending on the circumstances, a customer may be entitled to have a problem rectified, cancel a service agreement, receive a refund or obtain another remedy required by law.

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified. Any limitation of liability applies only to the extent permitted by applicable law.

For questions about a service or an Australian Consumer Law-related concern, please contact katie@katiekaars.com.

6. Refund procedure and service concerns

6.1 Photography sessions

Photography cancellations and refunds are handled in accordance with Section 2.2, the signed photography contract, our Cancellations & Refunds Policy and applicable law.

6.2 Pix Fix

Pix Fix cancellations and refunds are handled in accordance with Section 2.3, the applicable purchase arrangements and Australian Consumer Law.

6.3 Contact and remedies

For a question about a booking, cancellation, service concern or refund, please contact katie@katiekaars.com with your relevant booking details.

We will review the concern, respond within a reasonable timeframe and discuss the available options. Nothing in this procedure limits statutory consumer rights.

7. Intellectual property, image licensing and photographs

7.1 Photography session image licensing

Katie Kaars retains copyright in the photographs created during photography sessions, including any RAW files supplied. Copyright is not transferred to the client.

Once the agreed photography fees have been paid in full, the client receives a non-exclusive licence to use, reproduce and display the photographs according to the signed photography contract.

The licence covers internal business purposes and the promotion of the client's business, brand, services or professional activities. Within the agreed scope, this includes the client's website, social media, and digital or printed promotional materials.

The client may edit or adapt photographs to the extent necessary for uses permitted by the photography contract. Uses outside the agreed licence require Katie's written agreement and may attract a further fee.

If clients provide text, branding, images or other material for use in the photography services, they must own it or have the necessary permission to use it, as set out in the photography contract.

The photography contract also provides Katie with permission to use photographs from photography sessions for reasonable general promotional advertising, including on her website, social media and in industry competitions.

The signed photography contract describes the specific permissions and any agreed limitations applicable to the session.

7.2 Photographs submitted for Pix Fix

When submitting photographs for Pix Fix, you confirm that you own them or have the necessary permission to submit them for review. You retain the rights you hold in those photographs.

Katie may access and use submitted photographs to prepare and deliver the personalised review, including displaying them within the private feedback video where needed.

Photographs submitted for Pix Fix will not be used in public marketing, social media or promotional examples without separate permission.

Further information about personal information and submitted photographs is provided in our Privacy Policy.

8. Dispute resolution

If a dispute arises concerning a photography session or Pix Fix review, please contact us first so that we can try to resolve the matter fairly and promptly.

If we cannot resolve the matter directly, the parties may agree to mediation in New South Wales or another mutually agreed location.

Where a signed photography contract applies, its dispute and jurisdiction provisions should also be considered, subject to applicable law.

Nothing in this section prevents a customer from exercising a statutory right or accessing a court or tribunal where permitted by law.

9. Variation

We may update these Terms & Conditions from time to time by publishing a revised version on our website. Updated terms generally apply to future bookings and purchases.

Any changes affecting an existing confirmed booking or signed photography contract will be handled according to the relevant agreement and applicable law.

10. Severance

If any part of these Terms & Conditions is found to be void or unenforceable by a court of competent jurisdiction, that part will be severed to the extent necessary, and the remaining provisions will continue in force.

11. Termination

Cancellation or termination of a photography session or Pix Fix review will be handled according to the relevant agreement, these Terms & Conditions and applicable law.

If we cannot provide an agreed service, we will contact you to discuss suitable arrangements, including rescheduling or a refund or other remedy required by law.

12. Jurisdiction

Katie Kaars is based in New South Wales, Australia. These Terms & Conditions are governed by the laws of New South Wales, subject to any law that applies regardless of this clause.

The signed photography contract also contains provisions concerning the resolution of disputes relating to photography services.

Nothing in this section limits mandatory consumer rights or any statutory right to bring a claim in an appropriate court or tribunal.
